1. Terms and Definitions

1.1. For the purposes of this User Agreement (hereinafter referred to as the Agreement), the following terms have the following meanings:

1.1.1. Website — An Internet resource located on the Internet in the ARMAUTO.AM domain. The Site, depending on the context, also means the software of the Site, the design (graphic design) of the Site, the Database, any section (subsection) of the Site (ads, Forum, etc.), as well as Information posted on the Site by the Site Administration and Users.

1.1.2. Site administration — ARMAUTO.AM, which has all the necessary rights in relation to the Site, including the right to use the domain name of the Site, and administers the Site.

1.1.3. Registration — the process of creating a User Account on the Site.

1.1.4. Authorization — the process of identifying a registered User by entering the User's mail (or other data) and password to gain access to the User Account, closed sections and advanced functionality of the Site.

1.1.5. User — a person who has passed the registration procedure. For the purposes of this Agreement, the User is also understood as a person who has not passed the Registration Procedure, but accesses the Site and / or uses and / or used it.

1.1.6. Customer — a legal or natural person carrying out commercial activities on the Site on the basis of an appropriate agreement with the Site Administration and registered as a User in the prescribed manner, having in certain cases access to additional functionality of the Site. The Customer is subject to all the rules of this Agreement established for other Users.

1.1.7. Commercial activity — repeated use of the Site for profit, for example, by posting multiple ads with the same contact details or from the same person, or after posting a certain number of ads in the same category. The Site Administration can independently determine the fact of conducting Commercial activities by Site Users.

1.1.8. User Account / Personal Account of the Customer — a special subsection of the Site that allows the User to access certain functionality of the Site, as well as access the User's Personal Information posted under the Account, and other Information. The Customer, in certain cases, gets access to a separate Account with additional functionality.

1.1.9. User's personal information — any information that the User provides about himself when registering (creating a User Account) or in the process of using the Site, including the User's personal data, as well as information that is automatically transmitted to the Site Administration in the process of using the Site using the software installed on the User's device, including IP address, information from cookies, information about the User's browser, geolocation data of the User's devices, data about the User's actions on the Site, as well as other data about the User.

1.1.10. Information — any information posted (posted) by the User or the Site Administration on the Site, including: advertisements for the sale of vehicles and the Signs assigned to them, messages on the Forum, Personal Information of the User, links to other sites, any text messages, photographs (images), audio and/or video works, computer programs, website design, etc.

1.1.11. Database — the totality of the Information posted on the Site. All Information posted on the Site, as well as the selection, grouping and arrangement of the Information, is the intellectual property of the Site Administration and (or) other copyright holders.

1.1.12. Blocking — temporary termination of the User's access to the resources of the Site, in some cases with the prohibition of authorization.

1.1.13. Freeze — termination of the display of Information on the Site (the Information itself, for example, ads, remains available to Users for modification and editing).

1.1.14. Forum — a section of the Site intended for communication between Users on topics set by the Site Administration or by the Users themselves.

1.1.15. Moderator — A User who, in comparison with other Users on the Site/Forum, has broader rights granted by the Site Administration in the manner prescribed by this Agreement.

1.1.16. Resale — is the use of the Site to advertise the sale of a vehicle:

• which is not registered to the User and/or the announcement of the sale of which has already been placed on the Site during the previous three months.

• The Site Administration can independently determine the fact of Resale by Users according to other criteria.

1.1.17. "Only on ARMAUTO.AM" — A sign assigned by the User to an advertisement for the sale of a vehicle, in respect of which the User, when creating or editing an advertisement, indicated that the placement is carried out only on ARMAUTO.AM. Announcements that have been assigned the "Only on ARMAUTO.AM" attribute may be highlighted with a special text and/or graphic designation. At the same time, the selection of such ads with a special text and / or graphic designation is not guaranteed, and may also occur with a delay.

1.1.18. "For sale by owner" — A sign assigned by the Site Administration to an advertisement for the sale of a vehicle on the terms of clause 6.14 of this Agreement. The sign informs that the User who placed the ad has provided the Site Administration with a copy of the driver's license and a copy of the vehicle registration certificate (CTC), in which the full name is identical, and the information in which matches the information specified in such an ad.

1.1.19. Feature — a designation that may accompany an advertisement for the sale of a vehicle on the Site, reflecting special characteristics (features) assigned to the User and / or an advertisement for the sale of a vehicle.

The content of the Sign is for reference only and does not indicate any statements, assurances or guarantees on the part of the Site Administration. The Site Administration has the right, at its discretion, to cancel the assignment of specific Features or Features in general.

The placement of some Features may be mandatory and not subject to exclusion at the request of Users.

For the purposes of assigning the Sign, the Site Administration has the right to process the Users' Personal Information in accordance with the provisions of this Agreement.

1.2. Any terms and concepts used in this Agreement and not reflected in the "Terms and Definitions" section will be interpreted in accordance with the meaning arising from the text of this Agreement. If the meaning of a term or concept cannot be determined from the text of this Agreement, then the meaning of the relevant term or concept is determined on the basis of the current legislation of the REPUBLIC OF ARMENIA or from the practice established on the Internet.

2. Subject and general provisions of this Agreement

2.1. This Agreement establishes the rules and conditions for using the Site, posting Information on the Site and the procedure for using such Information, as well as the general rules for participation in the Forum, and is an agreement between the User and the Site Administration.

2.2. Access to the Site, use of the Site and / or performance of any other actions on the Site by the User means that the User accepts and undertakes to comply with all the terms of this Agreement without reservations and exceptions. Registration of the User on the Site is possible only with additional confirmation by the User of acceptance of this Agreement. If the User does not agree with the terms of the Agreement, then he must immediately stop using the Site.

3. Registration on the Site

3.1. In order to gain access to all the features of the Site, a person must complete the registration procedure on the Site in one of the following ways:

3.1.1. perform a series of sequential actions to fill out the registration form, as a result of which a unique Account will be created for the User; or

3.1.2. perform a series of sequential actions to enter the Site through the OpenID technology or using accounts of social services Facebook, Twitter, Vkontakte and others, as a result of which the person becomes a registered User.

3.2. Any User has the right to have only one Account on the Site. If the User violates this rule, the Site Administration may block the User Accounts (including the Customer's Personal Account(s), or restrict the functionality of the User's use of the Site and / or the conditions for such use, and / or delete the User Information.

3.3. To register as a Customer and gain access to the Customer's Personal Account, the User who has passed the registration procedure on the Site must perform a number of certain actions (for more details - https://www.armauto.am/en/dealer https://ARMAUTO.AM/en/dealer).

3.4. The User agrees to provide true, accurate and complete information about himself in the registration form and to keep this information up to date. If this information changes, the User undertakes to change it as soon as possible. At the same time, the User agrees that the Site Administration has the right, but in general is not obliged to verify the accuracy of the information provided by the User about himself, or to exercise control over the User's legal capacity.

3.5. The Site Administration has the right to restrict the User's access to all or some of the features of the Site, delete the User Information if the User has provided incorrect information about himself, or the Site Administration will have reason to believe that the information provided by the User about himself is unreliable, incomplete, inaccurate, violates the terms of this Agreements or the User uses someone else's information.

3.6. The Site Administration reserves the right at any time to require the User to confirm the information provided by the User about himself, and to request supporting documents in this regard (in particular, identity documents). If the specified documents are not provided or if the User's information specified in the documents provided by him does not correspond to the information specified by the User about himself on the Site, and also in the case when the information specified by the User about himself on the Site does not allow identifying the User, the Site Administration by may, at its discretion, take the measures provided for in clause 3.5. Agreements.

3.7. In order to confirm the Information provided by the User, the Site Administration has the right to carry out a face-to-face check of the vehicle offered on the Site by the User for sale, as well as the original documents of the vehicle and identity documents. The verification can be carried out by representatives of the Site Administration both at the initiative of the Site Administration and in connection with the receipt of complaints against the User / information posted on the Site by third parties. The check can also be carried out by a representative of the Site Administration without disclosing information about his relationship to the Site Administration and without notification of the check (using the "mystery shopper" method).

During the inspection, the User, notified by the representative of the Site Administration about the inspection, is obliged to provide the representative of the Site Administration with access to the vehicle and provide the requested documents for review. During the inspection, a representative of the Site Administration has the right to photograph the vehicle and the documents provided by the User. The images obtained as a result of photofixation are stored and processed on the terms specified in section 5 of this Agreement for the purposes of executing this Agreement, as well as protecting the rights and interests of the Site Administration.

In the event of a clear evasion from passing the check, failure to provide access to the vehicle or documents during the check, confirmation of the placement by the User of false, incorrect, outdated Information on the Site, the Site Administration, at its discretion, may take the measures provided for in clause 3.5. Agreements.

4. Authorization on the Site

4.1. Actions performed by the User on the Site under his/her Account, which was entered through the credentials of third-party services or authorization using an e-mail address, will be considered performed on behalf of the User as the owner of the Account. The User is solely responsible for all actions performed by him on the Site, as well as for all actions performed on the Site by any other persons using the User Account.

4.2. The User undertakes not to disclose, not to transfer his login and password to third parties, and to take all necessary efforts to ensure that his login and password are not available to third parties. The user is solely responsible for the safety of his password, as well as for all the consequences that may arise as a result of its unauthorized and / or other use. The User is obliged to immediately notify the Site Administration of any case of unauthorized (not authorized by the User) authorization on the Site using a login and password and / or any violation (suspicions of violation) of the confidentiality of his password.

5. Personal information of the User

5.1. The Site Administration processes the User's Personal Information specified by him on the Site, transferred to the Site Administration on the basis of clause 3.6. Agreements, including data of the User Account, data of the User's user activity in the service, data of open sources.

The User agrees that his Personal Information contained in the User Account (Personal Account of the Customer) is publicly available, and any User of the Site can familiarize himself with it, with the exception of Personal Information, access to which the User can restrict if the appropriate functionality of the Site is available.

The Information specified by the User (including Personal Information), published by the User and available on the Site, is subject to display for an unlimited circle of persons solely for the purpose of providing the functionality of the Site. The information posted by the User on the Site is not intended for its collection and further distribution by third parties without obtaining a separate consent from the User.

5.2. The User's personal information is processed in order to provide the functionality of the Site, provide feedback on issues related to the use of the Site, ensure compliance with the requirements of the Agreement, as well as the legitimate interests of the Site Administration and for other purposes specified in this Agreement and the Privacy Policy.

5.3. The User undertakes not to post personal information of other persons on the Site, and not to use the personal information of other Users in any way that does not comply with the requirements of the legislation of the REPUBLIC OF ARMENIA in order to derive benefits and for any other purposes that do not correspond to the purposes of creating the Site and this Agreement.

5.4. The User can at any time change (update, supplement) or delete the Personal Information provided by him or part of it, if the relevant functionality is available on the Site.

5.5. The User agrees and confirms that the Site Administration has the right to store the history of interaction between Users through the relevant functions of the Site in order to monitor compliance with this Agreement, improve the quality of the functionality of the Site, and also within the framework of complying with the requirements of the law. Access of the Site Administration and persons involved by them to such a story is possible for the indicated purposes, as well as at the request of the participants in the interaction and in cases established by law.

6. Placement on the Website of Information

6.1. By posting Information on the Site, the User guarantees that he has all the necessary rights to post Information on the Site. If the User does not have the proper rights to post any Information on the Site, the User undertakes not to post such Information.

6.2. When posting Information on the Site, the User undertakes:

6.2.1. not post on the Site or send anywhere through / through the Site the following Information:

• defamatory, insulting, defamatory/degrading honor and/or dignity of third parties, containing threats;

• having the sole purpose of causing harm to third parties;

• violating the rights of citizens to private life and public order;

• promoting discrimination against people based on race, ethnicity, gender, religion, social status, sexual orientation or other characteristics;

• containing extremist materials, promoting and/or calling for a change in the constitutional order, unleashing a war, religious, racial or ethnic hatred, containing attempts to incite hatred or calls for violence;

• containing pornographic materials or other materials that offend morality;

• insulting the religious feelings of citizens;

• information of a "custom" nature, ie. Information created in someone's interests that do not correspond to the purposes of creating the Site;

• not post on the Site or send anywhere through / through the Site other Information that does not comply with the legislation of the REPUBLIC OF ARMENIA and / or this Agreement;

6.2.2. not publish Information on the Site, bypassing the procedure for posting Information established by the Site Administration;

6.2.3. not distribute on the Site and / or through the Site computer viruses or other computer codes, files or programs designed to violate, modify, block, destroy or limit the functionality of any computer or telecommunications equipment or program for unauthorized access, as well as serial numbers to commercial software products and programs for their generation, logins, passwords and other means for obtaining unauthorized access to the Site, as well as to paid resources on the Internet;

6.2.4. not post or otherwise use on the Site Information protected by intellectual property law (including, but not limited to, which affects any patent, trademark, copyright and / or related rights), and other information protected by law without the corresponding rights and permissions from the owner of such Information;

6.2.5. not post on the Site Information of a commercial nature, with the exception of places and services specially designed for this with the permission of the Site Administration;

6.2.6. not to place on the Site links to other Internet resources, the content of which is contrary to the requirements of the legislation of the REPUBLIC OF ARMENIA and/or this Agreement;

6.2.7. not to distribute spam on the Site and / or through the Site, chain letters, Internet earnings systems, pyramid schemes, multi-level marketing, e-mail businesses;

6.2.8. not to register and not to perform actions on the Site on behalf of another real or existing person, not to indicate personal information of third parties, not to use any forms and methods of illegal representation of third parties;

6.2.9. do not post Information that is not related to the subject and objectives of the provision of the Site, the services provided by it and / or the subject of its sections, including not posting in advertisements for the sale of vehicles, Information that is not directly related to the description of the characteristics of the vehicle being sold, including any third parties, as well as Information of a comic, mocking, provocative, personal, propaganda nature, etc.;

6.3. The Site Administration provides the User with the opportunity to post Information on the Site and use the services of the Site solely within the framework of the provided functionality of the Site and the Application. The User agrees that the use of the Information posted on the Site in other services or on other sites is allowed only with the prior permission of the Site Administration.

6.3.1. The Site Administration provides the Site to the User "as is" and does not guarantee uninterrupted, fast, reliable and error-free operation of the Site.

6.4. Any Information posted on the Site by the User, respectively, belongs to such User or the relevant third party.

By posting Information on the Site, the User confirms that he has all the rights and powers necessary for this. By posting the Information, the User agrees that such Information, including the contact details specified by the User, vehicle data, will be available to an unlimited circle of people throughout the world. The Site Administration does not guarantee that the Information can be used solely for the purpose of using the functionality of the Site, and is not responsible for the actions of third parties to copy and process Information for purposes not related to the use of the Site.

6.5. By posting Information on the Site, including using the functions of the Application, the User automatically, free of charge, unconditionally and irrevocably grants the Site Administration a non-exclusive right to use such Information throughout the world for an unlimited period at the discretion of the Site Administration, including, but not limited to, reproduction, copying, selection, systematization, transformation, modification, editing, translation, publication, distribution of such Information (in part or in full) by any legal means, as well as for use by broadcast and cable. Also, by posting Information on the Site, the User confirms that he has the appropriate rights and powers to grant the Site Administration the above non-exclusive right to use the posted Information. With such use, the Site Administration has the right to use the relevant Information both with the name of the author of such Information, and without the name of the author (the name of the author will be the name of the User who posted the Information, which he indicated during registration on the Site or in the Account settings). records or User login). The Site Administration has the right to transfer the rights specified in this paragraph to third parties.

6.6. The Site Administration does not bear any responsibility for the accuracy and legitimacy of the Information posted by Users on the Site.

The Site Administration may (but is not obliged to) make changes to the content of the announcement in case of obvious errors and inaccuracies in the information posted by the User. In case of disagreement with the changes made, the User is obliged to immediately contact the Site Administration with an explanation and justification of his position.

6.7. The Site Administration does not check and does not have the technical and actual ability to check all the Information posted by the User on the Site for its compliance with the requirements of the legislation of the REPUBLIC OF ARMENIA and the provisions of this Agreement, since such a check will make the operation of the Site impossible. However, the Site Administration can do this at any time at its discretion, including in the manner provided for in clauses 3.6, 3.7. present agreement.

6.8. In the event of a disputable situation, the burden of proving that the Information posted by the User does not violate anyone's rights lies with such User.

6.9. The Site Administration may, at its discretion, refuse to post, delete and / or edit any Information that the User is going to post / posted on the Site, including without explanation.

6.10. In cases provided for by applicable law, the Site Administration considers the Information posted by the User on the Site, to which the User has restricted access for third parties using the Site's functionality, as a trade secret of the User. The Site Administration undertakes not to transfer such Information to third parties (except in cases of transfer of such Information between persons affiliated with the Site Administration or within the framework of the procedure established by the current legislation).

6.11. The placement of certain types of Information (announcements on the sale of vehicles, as well as Information posted on the Forum) is additionally regulated by the relevant sections of this Agreement, as well as other documents that the User agrees to when posting the relevant Information.

6.12. The Site Administration is not responsible for indicating by the User, when creating or editing an advertisement for the sale of a vehicle, that the placement is carried out only on ARMAUTO.AM. Assigning such an announcement the Sign "Only on ARMAUTO.AM" does not indicate any statements, assurances or guarantees on the part of the Site Administration that there is no announcement of the sale of this vehicle on other web resources similar to the Site. The site administration has the right, at its discretion, to cancel the assignment of the Sign “Only on ARMAUTO.AM” in case it is revealed that an advertisement for the sale of a vehicle has been posted on other web resources similar to the Site.

6.13. The sign "For sale by the owner" confirms that the Site Administration was provided with the documents specified in clause 1.1.18 of this Agreement, but does not provide any assurances or guarantees from the Site Administration that the User who posted the ad and / or the seller vehicle is the owner.

The Site Administration is not responsible for the accuracy and relevance of the information specified in the documents provided by the User when assigning the specified Sign, as well as for the consequences of the transaction concluded by the User in relation to the vehicle indicated in the ad with the assigned Sign. The presence of the Sign "For sale by the owner" does not deprive the User of the need to take all reasonable measures to establish the seller's authority to complete the transaction.

The site administration has the right, at its discretion, to cancel the assignment of the Sign "For sale by the owner" in case of any doubt about the grounds for its assignment.

7. Use of the Site

7.1. The use of the Site by the User is allowed only in accordance with this Agreement and exclusively in the ways provided for by the technical capabilities and interface of the Site.

7.2. The User undertakes when using the Site:

7.2.1. not disrupt the normal operation of the Site;

7.2.2. not distribute and/or use any computer programs, robots ("spiders") or other automatic algorithms and methods aimed at illegal: "pumping out" (collection), transmission, copying, blocking, modification, destruction of Information and the Database , as well as aimed at bypassing the restrictions set by the Site Administration in the Site settings;

7.2.3. not to use the contact details of Users for illegal mailings, including, but not limited to, SMS mailings made without the consent of the addressee;

7.2.4. not to perform actions through the Site aimed at extorting or receiving money, regardless of the pretext, from other Users and / or third parties;

7.2.5. not to assist in the commission and / or not to perform other unlawful, illegal actions using the Site that are contrary to the requirements of the legislation of the REPUBLIC OF ARMENIA and / or this Agreement.

7.3. Without the written permission of the Site Administration, the User undertakes not to use automatic programs to gain access to the Site in order to extract, collect, process, copy, and / or further distribute the Information presented on the Site and / or in the Database.

7.4. Users undertake to use the Information only for personal non-commercial purposes, unless permission for other use is given by the Site Administration and / or the relevant copyright holders.

7.5. It is allowed to quote Information in the amount of not more than fifty percent of the original text, subject to a mandatory link to the Site. The name of the Site must be reproduced in the specified form: “ARMAUTO.AM – Cars in ARMENIA, hyperlink – www.ARMAUTO.AM.

8. Operation of the Site and responsibility for its use

8.1. The Site Administration does not guarantee that the Information posted on the Site will be available at any time, or will not be deleted or lost. The Site Administration is not responsible for failures and delays in the operation of the Site, as well as for the possible consequences of such failures and delays.

8.2. The Site Administration is not responsible for the possible leakage of Information from the Site Database for any reason, including as a result of unauthorized actions of third parties.

8.3. The Site Administration is not responsible for the presence of viruses on the Site, as well as for the possible consequences of infecting the User's computer with viruses or getting other malicious programs on the User's computer. The Site Administration provides the Site to the User "as is" without any additional guarantees.

8.4. The Site Administration is not responsible, does not reimburse and is not liable for any losses, including lost profits, moral and other harm caused to the User or third parties as a result of their use of the Site or in connection with the operation of the Site, including for losses associated with making any decisions and actions based on the Information posted on the Site.

8.5. A link to any site, product, service, any information posted on the Site by the User is not an approval or recommendation of these products (services, information) by the Site Administration.

8.6. The User independently compensates for any losses (including lost profits, moral and other harm) incurred by other Users, third parties or the Site Administration as a result of the User's violation of this Agreement, including as a result of posting Information on the Site, as well as due to other actions, associated with the use of the Site.

8.7. The User undertakes on his own and at his own expense to resolve all disputes and settle all claims and lawsuits of third parties, instructions and requirements of authorized state authorities received both by the User and the Site Administration in connection with the violation by the User of this Agreement or in connection with with the commission by the User of other illegal actions when using the Site, as well as to reimburse all losses and expenses incurred by the Site Administration in connection with such claims and lawsuits.

8.8. The Site Administration is not responsible for agreements between Users and / or the User and any third parties concluded in connection with the use of the Site, including for the services of third parties that the User uses to pay for the services provided by the Site Administration (services of mobile operators, electronic payment systems, etc.).

8.9. Pages with advertisements for the sale of a vehicle may contain additional information about vehicles provided by the partners of the Site, including information about the presence of any restrictions on the vehicle, whether the vehicle is wanted, the conformity of the characteristics of the vehicle with the description specified in the advertisement for the sale vehicle, the availability of information about the accident, the history of ownership, etc. The information provided is for reference only and may not be correct. The Site Administration is not responsible for any loss, expenses, damages or damage associated with actions based on such information.

8.10. Pages with advertisements for the sale of a vehicle may contain additional information about the presence or absence of a vehicle in car dealerships. The information provided is for reference only and may not correspond to reality and (or) lose relevance at the time of actual contact with the dealership. The Site Administration is not responsible for any loss, expenses, damages or damage associated with actions based on such information.

8.11. The Site may have a "Vehicle History" feature that provides information about previous ads posted for a vehicle. The feature may only be available for listings that include a VIN. The information obtained using the Vehicle History function is for reference only. The Site Administration does not guarantee the reliability and accuracy of the information posted by Users in each of the ads, and is not responsible for the compliance of the information obtained using the "Car History" function with the User's goals and expectations, as well as for any losses associated with actions based on such information.

8.12. The Site Administration can assist the User in selecting a vehicle based on the information received from the User and the parameters set by him. Interaction with the User can be carried out through the operators of the Site support service during their telephone conversation with the User, or by filling out the feedback form on the Site by the User.

By transferring information during a conversation with a support service operator, or by sending an application filled out through the feedback form on the Site, the User agrees with the Site Administration to process the personal information provided by him on the terms of this Agreement, including the transfer of the received information to a potential seller of the vehicle in order to provide feedback on the purchase of a vehicle.

The Site Administration does not participate in further relations between the vehicle seller and the User, and also does not guarantee the actual selection of a vehicle that meets the User’s requests and expectations, feedback from the vehicle seller, the relevance of the vehicle seller’s offer at the time the User contacts it, and etc.

As part of the service provided to assist in the selection of a vehicle, the Site Administration may request data on the agreements concluded by the User, including a scanned copy of the vehicle purchase and sale agreement, in order to generate reports and process statistical data. The user expresses the consent of the Site Administration to the processing of the data specified in the above agreement, including personal information, on the terms of this Agreement.

8.13. On the Site, the User may have access to the functionality of sending and exchanging messages with other Users of the Site or the Site support service.

8.14. The User may have access to the function of sending an application for the selection of a loan and / or other financial service using the Site in credit institutions (hereinafter referred to as the Application) that are partners of the Site Administration.

The use of the function is carried out by the User free of charge.

The function provides the User with the opportunity to generate and send an Application to credit organizations for the latter to form a loan offer in order to compare them, as well as track the status of consideration of the Application by credit organizations on the Site and receive feedback on filling out and sending the Application.

As a result of sending the Application, the User is provided with a preliminary calculation of the loan offer, formed by credit institutions.

Accurate information about the terms of the concluded credit (loan) agreement, including the provision, use and repayment of the credit (loan), must be clarified with credit organizations. The information provided to the User within the framework of the function is for reference only and is provided by credit institutions for the purpose of comparing loan offers from credit institutions.

Information about the conditions for obtaining a loan, as well as the lending services themselves, are provided by credit organizations that are partners of the Site Administration. The Site Administration is not responsible for the reliability, accuracy, relevance of the information provided by credit institutions.

The Site Administration does not guarantee the approval of the Application by credit institutions sent using the function, and is not responsible for the processing of personal information transmitted to them, as well as for the quality of the services they provide. The Site Administration does not provide, as part of the function, services for providing consultations to Users related to the conclusion of loan agreements with credit organizations that are partners of the Site Administration, does not provide loans to Users.

The Site Administration is not an organizer, attorney, commission agent and / or agent of a credit organization and does not bear any responsibility for obligations arising from transactions concluded by a credit organization with Users.

8.15. The User on the Site may have access to the functionality of ordering the service "Onsite Car Diagnostics" provided to the Site Administration under the terms of the offer.

The user ordering the "Exit car diagnostics" service is hereby aware and agrees that in order to provide it, the data about his name, phone number, e-mail address can be used by the Site Administration for verification purposes. The user who places an advertisement for the sale of a vehicle is hereby aware and agrees that for the purposes of providing the "Onsite Car Diagnostics" service in relation to such a vehicle, the Site Administration may be provided with data on his name, phone number, e-mail address and VIN of the vehicle being sold .

The information received when ordering the "On-site vehicle diagnostics" service is for reference only. The Site Administration does not guarantee the reliability and accuracy of the information obtained using the "Onsite Car Diagnostics" service and is not responsible for the compliance of such information with the User's goals and expectations, as well as for any losses associated with actions based on such information.

The Site Administration is not a party to the contract for the sale of a car, as a result of which it is not responsible for the actions of the participants in the transaction under this contract

9. Other provisions

9.1. This Agreement shall be governed by and construed in accordance with the laws of the REPUBLIC OF ARMENIA. Issues not regulated by this Agreement shall be resolved in accordance with the legislation of the REPUBLIC OF ARMENIA. All possible disputes arising from the relations regulated by this Agreement shall be resolved in the manner prescribed by the current legislation of the REPUBLIC OF ARMENIA.

9.2. The User and the Site Administration will try to resolve all disputes and disagreements that have arisen between them through negotiations. If it is impossible to resolve disputes and disagreements through negotiations, they are subject to consideration in the appropriate court at the location of the Site Administration.

9.3. The relations arising between the User and the Site Administration within the framework of this Agreement are not subject to the rules on the protection of consumer rights due to their gratuitousness.

9.4. Nothing in the Agreement can be understood as the establishment between the User and the Website Administration of agency relations, partnership relations, relations on joint activities, personal employment relations, or any other relations not expressly provided for in the Agreement.

9.5. If, for one reason or another, one or more provisions of this Agreement are declared invalid or unenforceable, this does not affect the validity or applicability of the remaining provisions of the Agreement.

9.6. Inaction on the part of the Site Administration in case of violation by the User or other Users of the provisions of the Agreement does not deprive the Site Administration of the right to take appropriate actions to protect its interests later, and also does not mean the Site Administration waives its rights in the event of subsequent similar or similar violations.

9.7. This Agreement is drawn up in Russian and in some cases may be provided to the User for review in another language. In case of discrepancy between the Russian version of the Agreement and the version of the Agreement in another language, the provisions of the Armenian version of the Agreement shall apply.

9.8. This Agreement may be changed by the Site Administration unilaterally. The new version of the Agreement comes into force from the moment it is posted on the Internet at the address specified in this paragraph, unless otherwise provided by the new version of the Agreement. The current version of the Agreement is always located on the page at https://www.armaruto.am/en/legal/terms_of_servicepages/ If the Site Administration has made any changes to the Agreement with which the User does not agree, he is obliged to stop using the Site.

10. General rules for publishing advertisements for the sale of vehicles

10.1. All announcements are accepted for publication only in Russian/Armenian/English. The presence of additional information in another language is allowed, provided that there is a Russian/Armenian/English description for it.

10.2. Placed ads can undergo moderation - checking ads by the Site Administration for the correctness of the content and compliance with this User Agreement.

10.3. Posting the same ads (including: posting ads for the sale of the same vehicle, from different Accounts) or duplicating ads in different sections, regions or brands, as well as posting (in order to change the publication date) ads that are the same or are similar in most parameters to previously deleted ads (until 60 days have passed since the removal of such an ad), are prohibited.

10.4. Any Commercial activity (clause 1.1.7.) and Resale (clause 1.1.16) not agreed with the Site Administration is prohibited on the Site. If the User plans to carry out or carries out Commercial activities and / or Resale on the Site, he is obliged to notify the Administration about this via a chat with support on the Site. Users who violate this rule when posting ads may be blocked with the removal of all posted Information, or other measures may be applied to them, including such users may be prohibited from posting free ads for the sale of vehicles on the Site.

10.5. When placing an ad, the following rules must be observed:

10.5.1. carefully and consistently indicate the Information in the form for submitting an advertisement;

10.5.2. the advertisement must contain the most detailed information about the proposed (single) vehicle (hereinafter referred to as the "Product"). Information must be up-to-date and true;

10.5.3. images (photos, video materials) demonstrating the Goods must correspond to the content of the ad. The image should contain only the Goods offered for sale in the condition in which the Goods are at the time of the advertisement;

10.6. When placing an ad, it is prohibited:

10.6.1. indicate an underestimated or outdated price, for example, the price without VAT, the amount of the initial payment when buying on credit, the price taking into account discounts, promotions and special offers, etc. if such price is not the final sale price;

10.6.2. use other people's images (for example, photos from the official websites of manufacturers), as well as images previously published on the Site by other users;

10.6.3. place advertisements for the purchase of Goods;

10.6.4. place on photographs or video materials, including images obtained using the functions of the Application, trademarks, trade names and commercial designations, as well as any other advertising or contact information (phone numbers, email addresses, etc.), graphic inscriptions and images, except when such placement is agreed with the Site Administration;

10.6.5. indicate an incorrect or invalid contact phone number;

10.6.6. place advertisements for the sale of Goods in respect of which an agreement has already been reached on their sale to third parties and an advance payment or deposit has been made;

10.6.7. place Goods in brands/sections that do not correspond to the brand/section of the Goods sold;

10.6.8. post ads, the content of which is aimed at achieving a goal other than the sale of the Goods declared in the ad, including ads containing explicit or implicit advertising of the goods / services of the User or third parties, or information that discredits the goods / services of third parties, etc.

10.6.9. post photos or video materials, including images obtained using the functions of the Application, containing personal data, including images, of third parties.

10.6.10. indicate Armenia as the location of this vehicle if it is still abroad or has not yet arrived in Armenia.

10.6.11. mention that this vehicle has passed customs clearance if it is still abroad and the process is not completed in Armenia.

10.7. When filling in the fields "Additional information", "Enter a description" in the ad, it is prohibited:

10.7.1. provide links to any websites or email addresses;

10.7.2. indicate phone numbers, addresses, QR codes, names of accounts in social networks and links to them, hashtags, etc.;

10.7.3. indicate the price of the Goods;

10.7.4. without the consent of the Site Administration to offer any services that are not related to the Goods being sold, in particular, it is forbidden to indicate information about insurance, lending, exchanging a vehicle or accepting a vehicle against the purchase of another, information about services for removing and setting up a vehicle for registration, etc.

10.8. The Site Administration reserves the right to restrict access to ads that, in its opinion, violate this Agreement or violate other obligations of the User to the Site Administration, as well as to restrict the User's access to the Site to prevent further violations. For gross and / or repeated violations of this Agreement, the User's access to the Site may be permanently limited. In case of restriction of access on the grounds specified in this paragraph to ads for which the relevant services are ordered, or to ads for which additional functionality has been paid for by the User, the paid funds are not returned.

10.9. It is forbidden to place ads for the sale of the following Products:

• goods obtained by criminal means (by theft, illegal import into the territory of the REPUBLIC OF ARMENIA, etc.);

• goods intended solely for the purpose of violating and circumventing the current legislation of the REPUBLIC OF ARMENIA;

• goods whose circulation is prohibited or restricted in accordance with the legislation of the REPUBLIC OF ARMENIA;

• goods whose turnover violates the exclusive rights of third parties to the results of intellectual activity and means of individualization belonging to them;

• certifying documents and state marks;

• goods that do not belong to the category of vehicles.

11. Rules for publishing advertisements for the sale of vehicles

11.1. When placing an ad, it is prohibited:

11.1.1. sell vehicles without documents or documents without vehicles;

11.1.2. place advertisements for the sale of vehicles without the intention of alienating them with the transfer of ownership to the buyer;

11.1.3. post advertisements for the sale of vehicles that are wanted or for which there are any restrictions, including restrictions on registration actions.

11.2. A User who does not carry out commercial activities and / or Resale on the Site may be given the opportunity to post a limited number of ads for free, provided that he complies with the requirements of this Agreement. The number of announcements may vary depending on the region of publication.

Identification of the facts of commercial activity and / or Resale on the Site after the User has placed ads within the established limits on a free basis may lead to a change in the conditions for placing ads. In such cases, the Site Administration has the right to demand payment for ads previously placed by the User on a free basis, or exclusion of the relevant ads.

11.3. In order to ensure the privacy and security of Users, information on ads posted by Users (including the state registration number of the vehicle) may be subject to concealment by the Site Administration.
